Abstract

Examines the development of the law to protect women at risk of FGM, with particular reference to Kenyan and Gambian cases. Looks at the conflict between two recent decisions on similar facts from appellants at risk of FGM on return to the Gambia. Considers the use of numerous variables to assess the risk of FGM on return to the country of origin. Also considers the potential blurring of the lower standard of proof by the elaborate nature of this risk assessment.
